    Cyclists protest - want stiffer penalties for motorists who it bicycles

    Look, I'm all for promoting awareness, but cyclists demanding to share the road and be treated just like motorists, then turning around and demanding to be treated differently when it comes to accidents is a crock of hypocritical crap.

    After a cyclist is severely injured and another killed within a matter of days, the cycling community is rallying for change.
    The man behind the group Please Be Kind to Cyclists wants stiffer penalties against drivers, who strike and kill people on bikes. He wants drivers to face the same punishment as if it were a DWI crash.
    On Saturday afternoon, a 55-year-old man was killed, when he was struck by a driver off Highway 360 and Westbank Drive. His death marks the third cyclist to die after being hit by a car this year here in the Austin area.

    APD Chief Art Acevedo agrees with him.
    "We give a pass to people, who kill people too frequently here in our society in Texas for killing people while they're driving. I think that when we know that most crashes are a direct result of behavior, and behavior many times is the violation of transportation codes, somebody going too fast, not signaling, somebody blowing red lights or stop signs. Then when somebody dies, there is room for improvement on the accountability piece,” said Acevedo. “We've had people killed throughout the years since I've been here that in other places I've worked, they've been prosecuted for felonies. They would have been prosecuted for manslaughter, vehicular manslaughter. In our state and our county there is no prosecution. That's a problem."

    Until cyclists start behaving like car drivers, I can't get behind their movement. And that will never happen.
    You can't say you're a vehicle and then go up on a sidewalk or blow through inconvenient stop signs and red lights.

    Police and fix your own community, then come talk to us.

    Then ban bikes from all thoroughfares that have a speed limit of 45 & above.

    This is spot on. I know there are those that follow the rules of the road but all it takes is one cyclist to $#@! around and get killed then you get something like this.

    Okay, guys, let's do this. But we must follow the goose and gander rule.

    Things that will be punishable as if a DWI:

    1. Hitting and killing a bicyclist who has the right of way.
    2. A bicycle running a stop sign.
    3. A bicycle making an unsafe lane change.
    4. A bicycle failing to signal a turn.

    Interestingly, I have NEVER seen item 1. I have seen items 2-4, often resulting in near-misses, approximately eleventy billion times.

    When you put a small, slow conveyance, with no protection for the rider, on the road in close proximity to 2000 pound vehicles going at highway speeds, $#@! will happen. If it happens because a motorist makes an unsafe lane change, is speeding, etc., then the charge should be . . . the charge you would file against a motorist for causing a fatal accident with another can because he made an unsafe lane change, was speeding, etc. In the case of the recent death, it looks like an elderly driver wandered from his lane and collided with the cyclist. Elderly drivers wander from their lane and have collisions regularly. Sometimes, they are fatal. This one is no different. The lesson here is not "RESPECT CYCLISTS! THEY RULE!" Instead, it's probably "sometimes, old people should stop driving before they kill somebody."

    Seriously. There are intersections in central Austin where we should set up a camera to record what cyclists do. At some of them, I would bet that the rate of running the light/stop sign is better than 75%.

    In any forum or venue in life, the rule is the same -- to get respect, you gotta give respect. Instead, I am constantly on my toes looking out for cyclists, because they are about to make some dumbass move, and then flip me off for jamming on my brakes or honking at them as they dart in front of me. I look out for them. Not because I respect them, but because I don't want to kill anyone. As it's their ass on the line, you think they would feel the same way, and ride smarter because they don't wanna die.

    To get respect, give respect. That is the predicate for every "respect cyclists" rant we hear. They need to acknowledge that, and then realize that as a class, cyclists fall WOEFULLY short of that standard.

    agreed. until cyclist start following traffic laws and rules, $#@! them. i routinely see bikers blow pass stop signs and red lights. at red lights when cars are lined up, some bikers will weave through cars to get to the front so when the light turns green, everyone in the right lane is again stuck behind a $#@!head going 10mph. $#@! you, you line cutting $#@! guzzler listeater hipster!

    I haven't seen anyone killed thankfully, but I've seen several accidents where the bike had the right of way and the driver was just being an ass. I nearly got run over at Skillman and SouthWestern in Dallas coming back from White Rock Lake years ago. Big F-250 decided he was taking a right onto Southwestern and didn't give a $#@! that I was at the stop light (fully stopped) before him. It turned green and started going and he just passed me mid intersection and turned right in front of me, clipping my front tire.

    I wholeheartedly support increasing bike lanes EVERYWHERE, and at least partially funding that with registration fees for bikes. Will work out better for everyone.

    Man, I almost killed a cyclist in our barrio the other day. He was flying down a steep hill and decided to skip his stop sign AND turn on my side of the road. If I wasn't an alert driver at that moment, I would have t-boned him, or damn near hit him head-on, and he would have achieved flight for no less than 20 seconds.

    I don't agree there should be stiffer penalties. That just doesn't make sense. Art will say anything to cater to a special interest group.

    Twice this past weekend I was at a red light and a cyclist rode the center line to get up to the light. Light turns green? They pulled right in front of me and proceeded to go 10 mph.

    Hit another red light? One of the bikes just cruises through.

    Obey the traffic laws then come complain about being hit.

    Even if you do though, you're riding a bike on a street with cars. If you are involved in a accident you're going to get injured. Maybe even fatally injured. It's a risk you are taking.

    Apparently the most recent death was a guy minding his own business and just biking the shoulder on 360. It is dangerous enough being out there, but the old guy just drove into the shoulder and hit him from the looks of things. I think KVUE had interviewed some friends of the bicyclist and they were saying that safety measures like a railed off section of the road need to be installed on 360... Who the $#@! is supposed to pay for that??

    I cycle every saturday morning with a group. we roll out at 7am and stick to roads that are less than 45mph. We stop at stop signs and red lights. We do signal. We do not ride 4 wide. We try to ride single file or at most two wide (on a four lane road, so we are not blocking traffic).

    That said, I have seen other groups take up the entire two lanes of road, just to be $#@!s. I have watched the weaving to get to the front of traffic. It irritates me because those $#@!s make it more dangerous for me and the folks I ride with that respect motorists. It has to be a two way relationship between cyclists and motorists and right now, its more of a huge fight.

    Require them to be licensed & pay for tags & inspections just like motorists.

    Then ban bikes from all thoroughfares that have a speed limit of 45 & above.
    My bet is that 99% of cyclists own a car or two so we do pay for tags and inspections and gas tax and all that other $#@! for the roads.

    It's a speed limit. Limit is the MAX you can go. A road that has a minimum in almost all cases is already banned for cyclists.

    We as society should protect those that are more vulnerable just like we would a pedestrian or a kid getting off a bus.

    IMO you run a light and get killed your bike should be sold to pay for damage to the car that killed you.

    Here's a right-of-way question...
    Car and cyclist both going the same direction. Car is in front of the cyclist by 20-30 yds. Stoplight approaching where car will be taking a righthand turn. Cyclist will be going straight. The light is green.
    Does the car have the right of way to turn, or does he need to slow down to let the cyclist go straight before he turns? If the car has the right of way, at what point would he not? When the cyclist is even with him? Would the answer change if there is no light and you are turning into a neighborhood or strip mall?

    I've been in this situation a few times, and I usually anticipate the turn, meaning I speed the $#@! up to make sure I am turning well before the cyclist gets to the intersection. But that is not always possible. If I am even with the cyclist I slow down and let him go through the intersection. If I am in front of the cyclist, I turn. I've been met with a few middle fingers from this, I guess because the cyclist was annoyed he had to hit his brakes, but I find that more desireable than coming to a stop in the middle of a busy road.

    it obviously depends on the area. In NYC, bikes are not allowed on sidewalks at all (though that doesn't stop the delivery people). I think that is the most common rule, but by no means universal.

    I don't think it would cut down on cars on the road that much. I don't know anyone who would suddenly start riding a bike everywhere if there were more bike lanes. It's not an option for most people because of the distance alone.

    I don't have a problem with tags for bikes as well. We pay for tags for each car we own. I agree with the rest though.

    If you are in front of the cyclist, you have the right of way, same as if you were in a car. As long as you signal your intentions, it is up to the cyclist to slow down and avoid a collision.

    Depends where you are, weather, etc., but cities that have extensive bike lane system definitely see people choosing to bike over cars. When I was back at BofA during my brief consulting stint, the BofA Bryant Park tower had bike racks as part of its 'Green' push. I road my bike in from home several times and several times those racks were already completely full when I got there.

    Few weeks back there was a Critical Mass event in Houston (Oak Forest) at night. A bunch of cyclists (thousands) passed by the bar I was at and kept going through the red light holding every one up. I think the bulk of the group held it up for about 3 light cycles. Then the stragglers, the lost, and the smoker cyclists came through and held it up again a few more times.

    I changed my car size partially because of other drivers incompetence. I don't ride a motorcycle because drivers are horrible. I won't ride a bicycle (anywhere outside of the neighborhood) for the same reason. If they want to take the risk, go for it.
