WTF?Ruth told jurors he was on his knees building a fence when Rodriguez approached him and pointed a rifle at his face. He said Rodriguez then hit him between the eyes with the barrel.
"I felt he had some psychological issues," Ruth said. "He was violent."
Ruth said he took the gun away from Rodriguez and hit him with it. Although police intervened, no charges were filed.
The police in that jurisdiction are negligent. They should have filed charges for assault with a deadly weapon. (IIRC Second Degree Felony) At the time of the murder he should not have been able to legally own a firearm.
Did they let him off/preferential treatment because he was a firefighter?
