    $#@! You DOMA!!!!!

    I just got through doing taxes for our household today.

    I am steaming mad because I made the mistake of running the numbers to see what a Married Filing Jointly Return would look like.

    For reference, I have to pay $1460 to those $#@!s over and above the ~$18k they already took out of my check last year. The boyfriend is getting a $1200 refund.

    If we were to file jointly, instead of a net loss of $260 we'd instead be looking at a $4k+ refund!?! WTF?!?

    Filing jointly, I can write off student loan interest. I can't do that solo. Filing jointly, I get a Making Work Pay credit. I don't get that solo.

    God dammit, it really pisses me off to have to pay more to have less $#@!ing rights.

    Of course, that's just money. We wouldn't be in immigration limbo either if there was no DOMA.

    And of course, our problems are pretty trivial compared to this couple:

    the tax code is $#@!ed. Don't think the tax code is some conspiracy.

    For years I was hosed because I was married. My wife and I made pretty close to the same income. We paid far more than if we could file single.

    $#@! you marriage laws.

    In your particular case you get hosed. It's a tax issue and has nothing to do with DOMA.

    The Senate Judiciary Committee passed the Respect for Marriage Act, which would repeal DOMA, by a vote of 10 - 8. I'm assuming the vote went exactly down party lines but don't know that for sure.

    Then you can get divorced. It happens 50% of the time. Then you are back to square one.

    However, I do wish that your love/arrangement was acknowledged by our govt. I think its petty and stupid this is still even an issue in 2011.

    Time for part 2.

    We're doing health insurance renews at my company this week.

    Currently, I pay $15.83 per paycheck for health insurance for myself and the boyfriend. However, since I'm getting a benefit that the feds don't recognize, the ~$5k that my employer contributes to the boyfriend's portion of my health insurance is charged to me as imputed income and I'm taxed on that in addition to my salary. Some employers actually give extra money to an employee to compensate for the extra tax, but my employer doesn't, so ok, I'm on the hook for an extra $5k in taxable income. I'm not happy about this, but I'm also not going to be wasting a bunch of time worrying about it.

    So I'm going through my options this year and our cheaper option is switching from a PPO to a CDHP with HSA. This is actually not a bad deal based on our health care needs, so I was about to sign up when I noticed a caveat that blew the whole deal. Pretty much, the HSA money that I would put into the plan, and the matching funds that my company would provide to this plan, would only count towards my costs. Because of $#@!ing DOMA, the HSA money can't be applied to the boyfriend's medical expenses. This pretty much means that unless something catastrophic happens we're not meeting our deductible this year and therefore he's now going to be on the hook for all his medical expenses after tax, instead of going with the pretax HSA.

    Our other option is to move to the more expensive PPO plan which raises my bi-weekly deduction to 118.27.

    So, I can either pretty much drop him from my insurance, or our insurance costs year over year can increase by ~$2600.

    $#@! you DOMA. In the last year, just looking at my insurance and 1040 costs, not even counting the extra tax on the imputed income from my employer's contribution to his health insurance, I'm looking at an extra $7000 out of pocket. I'm also not counting the 4 years he had to be in school because he didn't win the H1B lottery. That was 4 years of no income and extra expenses as well.

    That's some bull$#@! right there.

    I kinda agree that it sets a bad precedent, but at the same time, House Republicans are paying a private firm to defend the law, so it's not as if it isn't being defended, and there's something to be said for the persons defending the law really believing in what they're advocating.

    I don't have the stats handy right now, but there is a thread about it around here somewhere where it was discussed in depth. Seems like every president going back at least as far as Carter has chosen not to defend at least one law. If you are interested in more of the back story, you can track down that thread from probably about 6 months ago.

    Meant to answer this too. Sadly, I am.

    We found out this week that the boyfriend's employer is going to sponsor him for a green card. That's $12k and 5 to 6 years. Were we to do it through marriage, it'd be done in 3 months and cost a lot less than that.

    Just because I follow the law doesn't mean I lose the ability to bitch about dumb laws!

    Before one of you bros try to come at me, I believe that if we are going to keep any sort of income tax, it needs to be one flat rate across the board with absolutely zero deductions. If it's 10% than that's what everyone pays, regardless of who you marry, how many kids you have, etc.

    As far as I am aware, it does not affect it at all. If a company wants to offer same sex benefits on its health insurance (regardless of state laws), they are free to do so.

    Straight people don't get them. Married people do. I certainly understand the cry for lower taxes, but the title of this thread wasn't "$#@! you, non-flat tax system!"
